TERMS & CONDITIONS

By booking or engaging the services of James Thomson Pet Photography (“the Photographer,” “we,” “us”), the Client (“you”) agrees to be bound by the following Agreement.

1. FEES AND PAYMENTS

  • Booking & Session Fees: We do not charge a booking or session fee for private in-home services. Exceptions apply only for long-distance travel or unique expenses, which will be agreed upon in writing beforehand.

  • Product Payment: Image viewing, selection, and ordering occur shortly after the session at a mutually agreed time. Full payment is required at the time of ordering. * Order Fulfillment: No digital files or physical products will be processed or released until full payment is received.

  • Unpurchased Images: The Photographer is not obligated to store non purchased image proofs beyond 14 days of the gallery being loaded.

  • Pricing: While we honor prices agreed upon at the time of booking, all other quoted prices are subject to change without notice.

2. SESSION POLICIES

  • Rescheduling/Cancellation: * By Client: Cancellations or rescheduling with less than 72 hours' notice may incur a re-booking fee at the Photographer’s discretion.

    • Weather: If inclement weather prevents an outdoor session, we will reschedule at the earliest mutual availability with no penalty.

    • By Photographer: If we must cancel due to illness or emergency, all fees paid will be refunded.

  • Pet Behaviour & Safety: * The Client is solely responsible for the pet’s safety, control, and behavior.

    • Any known aggressive or unpredictable behavior must be disclosed prior to the session.

    • We reserve the right to terminate a session immediately without refund if a pet is unmanageable or poses a danger.

3. IMAGE RIGHTS AND USAGE

  • Copyright: Under the Copyright Act 1968, James Thomson Pet Photography retains exclusive ownership of all Images.

  • Personal Use License: You are granted a non-exclusive license to use purchased high-resolution images for personal display, social media, and printing.

  • Prohibited Use: You may not sell, alter (beyond cropping/resizing), enter images into contests, or use them for commercial purposes without express written permission.

  • Photographer’s Use: Unless you request an exclusion in writing at the time of booking, you grant the Photographer permission to use images of your pet (and owner/handler) for marketing, portfolio, social media, and professional competitions.

4. ARTISTIC CONTROL & DELIVERY

  • Artistic Style: The Photographer retains creative discretion over lighting, composition, and post-processing.

  • Selection: We provide only the final, edited images. Unedited or RAW files remain our property and will not be released.

  • Delivery: Digital products are typically delivered via an online gallery within 48 hours of the session. Physical product timelines depend on third-party couriers (e.g., Australia Post).

  • Storage: Purchased images are archived for one year from the date of purchase. It is the Client’s responsibility to back up digital files immediately upon receipt.

5. LIABILITY & INDEMNITY

  • Limitation of Liability: In the event of technical failure or illness, our liability is limited to a full refund of fees paid.

  • Indemnity: The Client agrees to indemnify James Thomson Pet Photography against any claims, damages, or injuries involving persons, pets, or property during the session.

  • Governing Law: This agreement is governed by the laws of Queensland, Australia.

By proceeding with a booking or payment, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
